Terms of Use for Lane App Limited
1. Introduction
These Terms of Use govern your access to and use of the Lane App Ltd ("Lane App", "we", "our", or "us") platform, including our website, mobile application, and all related travel and hospitality services (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue your use of the Platform.
2. What we do
Lane App Ltd owns and operates Lane, a digital platform that allows users to book hotels and short-term rentals, reserve flights, train and bus tickets, hire vehicles, and access other travel and hospitality-related services. Lane acts solely as an intermediary, connecting users with third-party providers of accommodation, travel, transportation, and related services ("Service Providers").
When you make a booking through our Platform, you enter into a direct contractual relationship with the relevant Service Provider, and the Service Provider's own terms and conditions may also apply. Lane is not responsible for the quality, safety, suitability, legality, or availability of services provided by third-party Service Providers.
Unless expressly stated, Lane is not a real estate broker, property manager, or hotel operator. Property listings, descriptions, availability, and rates are provided by the Service Provider, and the responsibility for accuracy rests with them. Lane may, however, validate certain property information for quality and safety assurance.
3. Eligibility and Account Registration
You must be at least 18 years old and possess the legal capacity to enter into a binding contract to use the Platform. To use certain features of the Platform, you may be required to create an account. When creating an account, you agree to provide accurate and complete information and to keep your login details confidential. You are responsible for all activities that occur under your account, and you must notify us immediately of any unauthorized use or security breach. We reserve the right to suspend or terminate your account if we believe you have violated these Terms or engaged in activities that may harm the Platform, other users, or our business.
4. Acceptable Use of the Platform
Your use of the Platform must always be lawful and respectful. You must not engage in fraudulent or deceptive conduct, misuse or interfere with the Platform's functionality, violate the rights of others, attempt to bypass security systems, or use automated tools or scripts without our authorization. We may suspend or restrict access to the Platform if we detect misuse or harmful behavior.
5. Bookings and Reservations
When you make a booking on the Platform, you enter into a direct agreement with the Service Provider offering the listed apartment, hotel room, or short-let property.
Lane acts solely as a digital intermediary that enables you to discover listings, check availability, make reservations, and process payments. Lane is not a party to the accommodation contract created between you and the Service Provider.
A booking is not considered final until you receive a confirmation notice through the Platform. Service Providers maintain full discretion over their services and properties and may accept, decline, or cancel a booking or reservation in accordance with their individual policies, operational requirements, or applicable local regulations.
Before making a reservation, you are responsible for carefully reviewing all booking details, including property descriptions, amenities, pricing, house rules, check-in and check-out requirements, security deposits, cancellation and refund terms, and any additional fees communicated by the Service Provider. By completing a booking, you acknowledge and agree to be bound by the terms and conditions set by the Service Provider for that property.
6. Payments and Pricing
When you make payments through the Platform, you authorize Lane or our payment partners to charge your selected payment method for the cost of the booking, including any taxes, fees, or surcharges imposed by the Service Provider or by law. Some bookings may require full prepayment, non-refundable charges, or security deposits. We display pricing information as provided by Service Providers, and prices may vary based on availability, season, or other factors. Failure to complete payment may result in cancellation.
7. Cancellations, Modifications, and Refunds
All cancellations, refunds, rescheduling, or modifications of bookings made through the Platform are strictly subject to the applicable terms, conditions, and policies of the relevant Service provider. Lane App does not set, control, or guarantee any cancellation, refund, or modification terms and does not have authority to override the policies of any Service Provider.
Some Service Providers may impose cancellation fees, amendment charges, administrative costs, or may offer bookings on a non-refundable or non-modifiable basis. You acknowledge and agree that any such fees, restrictions, or losses arising from a cancellation, refund request, or modification are your sole responsibility.
Lane App will not bear any liability for any refusal, delay, partial refund, or non-refund by a Service Provider, nor for any costs, penalties, or losses arising from the Service Provider's policies or decisions. However, where issues arise, Lane App will make reasonable efforts to assist you by facilitating communication with the relevant Service Provider, without guaranteeing any specific result or outcome.
8. User-Generated Content
You may submit reviews, feedback, or other content on the Platform. You retain ownership of your content but grant Lane a non-exclusive, royalty-free, worldwide license to use, display, distribute, and reproduce such content for operational and marketing purposes. You agree that your content will be truthful, respectful, and lawful. We may remove or moderate content at our discretion.
9. Intellectual Property
All intellectual property on the Platform, including the interface, design, software, trademarks, and content, belongs to Lane App Ltd or its Partners. You may not copy, reproduce, distribute, modify, reverse engineer, or exploit any part of the Platform without our prior written consent.
10. Privacy and Data Protection
Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, share, and protect your Personal Data. By using the Platform, you consent to the processing of your data as described in our Privacy Policy.
11. Third-Party Websites and Services
The Platform may include links or access to third-party websites and services. Lane is not responsible for the content, accuracy, or practices of these external websites, nor for the performance or conduct of third-party Service Providers. You access third-party services at your own risk.
12. Platform Availability and Technical Issues
While we strive to keep the Platform accessible at all times, we do not guarantee uninterrupted or error-free operation. Access may be temporarily suspended for maintenance, upgrades, system failures, or other operational reasons. Lane is not liable for losses arising from downtime, technical issues, or disruptions outside our control.
13. Limitation of Liability
Lane's liability to you is limited to the maximum extent permitted by law. We do not accept liability for indirect, incidental, special, or consequential damages, or for issues arising from the acts, omissions, or services of third-party Service Providers.
The Platform is provided "as is" and "as available," without warranties of any kind. Lane does not guarantee uninterrupted access, error-free functionality, or the accuracy of listing content. If you are dissatisfied with the Platform or these Terms, your sole remedy is to discontinue use of the Platform.
To the maximum extent permitted by law, Lane will not be liable for:
- Losses arising from property defects, host misconduct, or inaccurate listings.
- Indirect, incidental, or consequential damages.
- Issues caused by third-party service providers, payment gateways, or network failures.
- Personal injuries or property damage occurring at host accommodations.
Lane's total liability for any claim relating to your use of the Platform will not exceed the total amount paid by you for the booking giving rise to the claim.
14. Indemnification
You agree to indemnify and hold Lane App Ltd harmless from any claims, losses, damages, liabilities, or expenses arising from your misuse of the Platform, your violation of these Terms, or your interactions with third-party Service Providers.
15. Suspension and Termination
We may suspend or terminate your account or restrict your access to the Platform if you breach these Terms or engage in behavior that may harm the Platform or our users. You may voluntarily close your account at any time by contacting our support team. Even after termination, we may retain certain information as required by law or for legitimate business purposes. Termination does not waive any rights or obligations accrued before the date of termination.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms shall first be addressed through good-faith negotiation. If not resolved, the dispute may be submitted to mediation, arbitration, or a court of competent jurisdiction, depending on applicable law.
17. Changes to These Terms
We may update or modify these Terms at any time. Updated Terms will be posted on the Platform with the applicable "Last Updated" date. Lane may revise these Terms from time to time to reflect changes in law, our business operations, or improvements to the Platform. Where significant changes are made, we will notify you through the Platform or via email. Your continued use of the Platform after any update constitutes your acceptance of the revised Terms.
